Clause 1 Parties and Acceptance
1.1 These Terms of Service (the "Terms") are an agreement between Dragon Hispeed Co., Ltd. (the "Provider"), which provides services under the names Dragonhispeed, Hosting Hispeed and HostParagon, and the applicant or user of the services (the "Customer"), covering web hosting, email hosting, email server, VPS, server, domain registration, SSL certificate and related services (the "Services").
1.2 The Customer accepts these Terms by clicking to accept them during ordering or in the member system. Clicking to accept has the same effect as a signature under the law on electronic transactions. The Provider keeps a record of each acceptance, namely the user account, the version of the Terms, the date and time, and the IP address, as evidence.
1.3 The following documents form part of these Terms: (a) the Data Processing Agreement (DPA); (b) the package details and prices published on the website on the date of the order; (c) any separate written enterprise agreement. In case of conflict, (c) applies first, then the DPA on matters of personal data, and these Terms on all other matters.
1.4 The Provider collects and uses the Customer's personal data in accordance with the privacy policy published on the website (https://accounts.dragonhispeed.com/legal/privacy).
1.5 The Customer must be at least 20 years of age or have the consent of their legal representative. A person applying on behalf of a juristic person represents that they have authority to act on its behalf.
Clause 2 User Account and Security
2.1 The Customer must provide accurate, complete and up-to-date information, in particular their email address and telephone number, which the Provider uses to give important notices such as invoices, expiry notices and security incidents. A notice sent to the email address on the account is deemed received by the Customer.
2.2 The Customer is responsible for keeping their password safe and for all actions taken under their account. The Provider recommends enabling two-factor authentication (2FA). If the Customer suspects that their account has been used without authorization, they must notify the Provider immediately.
2.3 The Provider will never ask for the Customer's password by telephone, email or chat, and will never ask for payment to a personal bank account. Payments are made only through the channels in the member system or to the company bank accounts published on the website.
2.4 For security reasons, the Provider may require identity verification before carrying out a high-risk action, such as changing the account email address, issuing a domain transfer code or changing a domain registrant.
Clause 3 Orders, Payment and Renewal
3.1 All Services are prepaid. A Service starts when the Provider has received payment in full.
3.2 Published prices exclude value added tax unless stated otherwise. A juristic-person Customer that withholds tax must send the withholding tax certificate within 30 days; otherwise the withheld amount is treated as outstanding.
3.3 The Provider issues renewal invoices and sends reminders by email before the expiry date. Not receiving an email does not release the Customer from the duty to renew. The Customer can check expiry dates in the member system at any time.
3.4 If payment is not made by the expiry date, the Provider may suspend the Service, and if payment is still not made within 30 days after the expiry date, the Provider may cancel the Service and delete all its data without further notice. A fee may apply to reactivate a suspended Service.
3.5 The Provider may change the price for the next renewal period by publishing it on the website or notifying the Customer by email at least 30 days in advance. The price already paid does not change for the current period.
3.6 If the Customer initiates a card chargeback without reasonable grounds, the Provider may suspend all Services on the account until payment is made in full, and may charge the Customer any fees incurred.
3.7 Reward points and account credit have no cash value, cannot be redeemed for money or transferred to others, and may be used only under the conditions published by the Provider.
Clause 4 Cancellation and Refunds
4.1 The Customer may cancel a Service at any time through the member system or the Provider's contact channels. The Provider may, at its discretion and case by case, refund the unused portion of the fees pro rata, excluding the fees under clause 4.2 and the cases under clause 4.4.
4.2 Fees for domain registration, renewal and transfer, SSL certificates and licensed software are non-refundable in all cases once the order has been placed with the third-party provider.
4.3 If the Provider cancels a Service on its own initiative while the Customer is not in breach of these Terms, the Provider will refund the unused portion of the fees on a pro rata basis.
4.4 If a Service is cancelled or suspended because the Customer breached these Terms, the Customer is not entitled to any refund.
Clause 5 Prohibited Use
5.1 The Customer must not use the Services, or allow others to use their Services, for any of the following:
(a) Illegal content: content that is illegal under Thai law or the law of any relevant country, content that is an offence under the law on computer-related offences, or content that affects national security, religion or the monarchy.
(b) Gambling and pornography: gambling of any kind, pornography, prostitution, and any content related to child sexual abuse in any form. If this is detected, the Provider will cancel the Service immediately and report it to the relevant authorities.
(c) Fraud: fake websites, phishing, impersonating other persons or organizations, pyramid schemes, investment scams, and the sale of illegal goods or services.
(d) Malicious software and attacks: distributing malware, viruses, ransomware or hacking tools; scanning or attacking other people's systems (including DDoS and brute force); operating as a botnet command-and-control server; and distributing pirated software (cracks, warez).
(e) Intellectual property: infringing the copyright, trademarks or other intellectual property of others, including distributing music, films or software without the right to do so.
(f) Spam: sending bulk advertising email or messages to recipients who did not ask for them, using email lists that were bought or collected without permission, forging the sender address, and advertising a website hosted on the Provider's Services through spam sent from elsewhere.
(g) Misuse of resources: cryptocurrency mining; running a proxy or VPN for public use; public file-hosting or image-hosting services; providing disk space, email or databases as a service to the public (except packages that permit resale); and any usage of CPU, memory or bandwidth that affects other customers on the same server.
(h) Personal data: unlawfully collecting, trading or disclosing the personal data of others.
5.2 Whether any usage falls under clause 5.1 is at the Provider's discretion, taking into account the security of the system and of other customers.
5.3 The Customer is responsible for all content on their Services, including content posted or uploaded by the Customer's users and content created with artificial intelligence tools. The Provider only provides the hosting space and does not review content in advance.
5.4 On notice from a government official, or on a complaint with evidence that content is illegal or infringes the rights of others, the Provider may block access to or remove that content under the notice-and-takedown procedure required by law, and will inform the Customer.
Clause 6 Email
6.1 Email packages have hourly and daily limits on the number of emails sent to external recipients, as stated in the package, to prevent spam and protect the reputation of the Provider's IP addresses. Emails sent to domains on the same server are not counted. A Customer who wants to send bulk marketing email must use a dedicated email-sending service.
6.2 Incoming and outgoing email passes through automatic spam and virus filtering. Email that the system judges to be spam or to contain a virus may be moved to the spam folder, quarantined, or not delivered. The Provider does not guarantee that every message will be classified correctly.
6.3 If a Customer's email account is used to send spam, whether because of a leaked password or any other cause, the Provider may suspend that account immediately and force a password change. If the Provider's IP addresses are blacklisted because of the Customer's usage, the Provider may charge the Customer the cost of remedying it.
6.4 The Provider does not guarantee that email sent will reach the recipient or the recipient's main inbox, as this depends on the recipient's system.
Clause 7 VPS and Email Server
7.1 No VPS or email server package includes system administration, unless the Customer has purchased a system administration service separately in writing.
7.2 While the Customer has not requested the administrator (root) password, the Provider holds that password and may log in to inspect, update or fix problems as it sees fit. This assistance is not a system administration service and does not create any duty or liability of the Provider to administer that system.
7.3 Once the Customer has requested the administrator password, the Customer is solely responsible for the server's operating system, software, configuration, updates, security and backups. Any assistance from the Provider after that may be charged.
7.4 The Provider is not responsible for any damage from a server that is compromised because of outdated software, weak passwords or the Customer's configuration, and may suspend a compromised server under clause 11.
7.5 VPS resources such as CPU, memory, disk space and bandwidth are as stated in the package. If usage is excessive and affects other customers on the same host server, the Provider may limit that usage.
Clause 8 Domains
8.1 Domain registration is carried out through accredited registrars and is subject to the rules of ICANN and of the registry for each extension, which form part of these Terms. The Provider does not guarantee that an ordered domain can be registered until the registrar confirms it.
8.2 The Customer must provide accurate and up-to-date registrant information. False information may cause the registrar to suspend or cancel the domain. Some extensions, such as .th, require supporting documents as specified by the registry.
8.3 The Customer is responsible for renewing domains before their expiry date. An expired domain may be suspended immediately. Recovering a domain after expiry (redemption) incurs a fee set by the registrar, and once the redemption period has passed, the domain may be released for others to register. The Provider is not responsible for any damage caused by an expired domain.
8.4 A domain that has just been registered, renewed, transferred or had its registrant changed may be locked from transfer out for 60 days under the registrar's rules.
8.5 The Customer can change name servers and domain settings through the member system and is responsible for the results of those settings.
8.6 The Customer represents that the registered domain name does not infringe any trademark or right of others. Domain name disputes are governed by the dispute resolution policy of the relevant registry.
Clause 9 Backups
9.1 Data is an important asset of the Customer. The Provider's automatic backups (daily, with 7 days of history, for packages that include them) are only a supplementary measure to help reduce damage. The Provider does not guarantee that backed-up data will be complete, correct or fully recoverable in every case.
9.2 The Customer has a duty to keep regular backups of their own data outside the Provider's systems, and before every significant change. Services whose package does not state that backups are included, including a VPS for which the Customer has received the administrator password, are treated as having no backups by the Provider.
9.3 Restoring data from a backup at the Customer's request, where the need does not arise from the Provider's fault, may be charged.
Clause 10 Service Availability and Support
10.1 The Provider endeavours to keep the Services available continuously, but does not guarantee that they will be uninterrupted or error-free, unless there is a written service level agreement (SLA).
10.2 The Provider may carry out maintenance from time to time and will give advance notice where possible. Urgent security fixes may be applied immediately without advance notice.
10.3 The Provider may move the Customer's Services to another server or system within Thailand of no lower specification for maintenance, security or system improvement, which may change the IP address.
10.4 Support covers the use of the Services within the features of the package. It does not include writing or modifying code, website design, or fixing problems with the Customer's CMS, plugins or software, although the Provider may suggest approaches or resources where reasonable.
Clause 11 Suspension and Cancellation by the Provider
11.1 The Provider may suspend all or part of the Services, delete harmful files, or restrict usage immediately and without prior notice if it finds that (a) the Customer has breached clause 5 or clause 6; (b) the Service has been compromised, infected with malware, or used to attack other systems; (c) the usage affects the security or stability of the system or of other customers; or (d) there is an order from a court or government authority. In such cases, the Provider will notify the Customer promptly after taking action.
11.2 Files that the system detects as viruses, malware or webshells may be deleted or quarantined automatically.
11.3 If a breach is serious, or is repeated after notice, the Provider may cancel all Services on the account without refund.
11.4 Suspension or cancellation under this clause is not a breach of contract by the Provider.
Clause 12 Liability and Indemnity
12.1 The Provider is liable only for actual direct damage that results directly from the Provider's failure to comply with these Terms.
12.2 The Provider is not liable for indirect or consequential damage, loss of profit, revenue, reputation, data or business opportunity, nor for damage caused by the Customer or the Customer's users, or by force majeure, including damage caused by the acts of third parties who are not personnel or subcontractors of the Provider, where the Provider has taken reasonable security measures.
12.3 If data is lost or damaged, the Provider will help restore it from the latest available backup (if any). If it cannot be restored because of the Provider's fault, the Provider will refund the fees for that Service pro rata for the remaining period, which is the Customer's sole remedy in that matter.
12.4 The Provider's total aggregate liability arising from or in connection with the Services, these Terms and the DPA, however many incidents occur, will not exceed the fees paid by the Customer to the Provider for the Service concerned in the 12 months before the incident, or THB 50,000, whichever is less.
12.5 Clauses 12.2 to 12.4 do not apply to damage caused by the Provider's wilful misconduct or gross negligence.
12.6 The Customer agrees to indemnify the Provider for any damages, fines and costs, including reasonable legal fees, that the Provider incurs as a result of content on the Customer's Services, use in breach of clause 5 or clause 6, or unlawful acts of the Customer or the Customer's users.
Clause 13 Force Majeure
The Provider is not liable for any delay or failure to provide the Services caused by events beyond its reasonable control, such as natural disasters, widespread power outages, failures of the Internet or of third-party providers, large-scale cyber attacks, epidemics or government orders.
Clause 14 Amendments
14.1 The Provider may amend these Terms by publishing the new version on the website and notifying the Customer by email at least 30 days in advance. If the Customer does not agree, the Customer may cancel the Services within that period and receive a pro rata refund of the unused fees.
14.2 Amendments made to comply with the law, or that do not reduce the Customer's rights, take effect as soon as they are published.
14.3 Continuing to use the Services after a new version of the Terms takes effect, or clicking to accept the new version in the member system, constitutes the Customer's acceptance of that version.
Clause 15 Miscellaneous
15.1 The Customer may not transfer their rights or duties under these Terms to any other person without the Provider's written consent. The Provider may transfer its rights and duties to an affiliated company or to a transferee of its business, with notice to the Customer.
15.2 If any provision of these Terms is invalid or unenforceable, the remaining provisions continue in full force.
15.3 A failure by the Provider to exercise any right under these Terms on any occasion is not a waiver of that right.
15.4 These Terms are governed by Thai law, and the Thai courts have jurisdiction over any dispute.
15.5 If these Terms exist in another language and the versions differ, the Thai version prevails.
